These terms cover your account and this website. How sending works, and what you are responsible for about your list, is in the Service Agreement. What we do with personal information is in the Privacy Policy. Using the service means you accept all three.
You need an account to buy or send. You must be old enough to enter a contract where you live, and if you are signing up for an organisation you must be allowed to bind it. Keep your credentials to yourself. Anything done through your account is treated as done by you.
Tell us promptly if you think somebody else has got into it.
Use the site for making and sending corporate greeting cards. Do not use it to break the law, to impersonate somebody, to distribute malware, or to produce material that is hateful, harassing, sexual, or that infringes somebody else's rights.
Do not attempt to get at accounts, data or systems that are not yours, and do not scrape, overload or reverse-engineer the service. If you find a security problem, tell us before you tell anybody else.
The templates, stock imagery, fonts, music and the software are ours or our licensors'. Buying a card buys you the right to use the card you made for your own business communications. It does not let you resell the template, extract its assets, or use them in something else.
Your logo, your photographs and your words stay yours. You give us only the permission we need to do the job: to store them, render them into your card, and show them on the page your recipients open. That permission ends with the card.
You are responsible for having the right to use whatever you upload, including photographs of identifiable people and any font or brand asset you supply.
Where you use the AI features (copy, colours, a generated logo), what comes back is yours to use in your card on the same footing as anything else you made here. We make no claim that generated material is unique, and it may resemble what another customer was shown. Check anything you intend to use as a trademark.
Prices are in US dollars and are shown before you pay, including which recipient band you are buying. Payment is taken by Stripe; we do not see or store your card number. Taxes are added where they apply.
Buying a band grants the sending credits for that band to your account. Additional credits can be bought separately at the rate shown at the time.
Where we invoice you rather than charge a card, which happens with a quoted campaign and with a size settled after a send, payment is due 30 days from the date of the invoice. After that we may charge interest at 1.5% per month on what is outstanding, and if we have to use a collection agent or a lawyer to recover it, that cost is yours.
Ask us. Refunds are handled by a person rather than a button, because what is fair depends on whether the card went out.
As a guide to what we will say:
When a refund is issued, this is what happens automatically:
Messages that have already been delivered cannot be recalled by us or by anyone, so a refund does not undo a campaign that has gone out.
We aim to keep the service up and we do not promise that it always will be. We may change or withdraw features, and we will give notice where a change would affect a card you have already bought. The 60-day hosting window for a purchased card is in the Service Agreement.
Email clients differ, and some of them differ a great deal. We build and test cards to render as widely as we can, and we cannot promise that every mail client and every browser will show a card identically. A difference in how a client draws your card is not a fault in the card, and it is not on its own a reason for a refund.
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits or goodwill, or for a campaign that under-performs. Our total liability for any claim is limited to what you paid us in the twelve months before it arose.
Nothing here limits liability that cannot be limited, such as for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow some of these exclusions, in which case they do not apply to you.
If a claim is made against us because of addresses you uploaded, content you supplied, or your breach of the permission rules, you will cover the cost of defending and settling it.
We build the card from what you give us. If a card is wrong because the information you supplied was wrong, putting it right is at your cost, and we are not liable for what follows from it. Check your preview before you send.
Your lists, your artwork and your campaign details are confidential. We use them to do the job you asked for and for nothing else, and we do not share them with anyone outside the providers named in the Privacy Policy, who are held to the same standard.
This does not stop us complying with a legal obligation, and it does not apply to anything that is already public or that you have published yourself.
Close your account whenever you want. We may suspend or close an account that breaches these terms or the Service Agreement, and we will tell you which. Sections 3, 7, 8 and 9 survive.
We may update these terms. The date at the top of this page is when they last changed, and where a change materially affects you we will tell you rather than relying on you noticing.
These terms are governed by the laws of the Province of Ontario, Canada, and the courts there have jurisdiction, without taking away any protection you have under the mandatory consumer law of the country you live in.
These terms, the Service Agreement and the Privacy Policy are the whole of the agreement between us. Where they disagree, the Service Agreement wins on anything about sending, the Privacy Policy wins on anything about personal information, and these terms win on everything else. What you agreed to in the app at the time, such as a list's consent attestation or a card's sending size, is part of the agreement for that list or that card.
